Respond to an Indian defective income-tax return notice
Use this for a defective-return notice shown in the Indian Income Tax Department e-Filing portal. It is not the same as a proposed adjustment under section 143(1)(a), a demand notice or a general tax inquiry. The Department's portal supports proceedings under both the Income-tax Act, 1961 and the Income-tax Act, 2025, so section numbers and the assessment-year/tax-year framework depend on the return and notice. Follow the section, response mode and exact due date printed in your authenticated notice; do not assume every notice is under section 139(9) or that every case gets the same number of days. If the defect changes a tax position, loss claim or disclosure, consult a qualified Indian tax professional before submitting. Do not upload a return or notice to an unrelated tool.

Authenticate the notice through the official pre-login service; sign in to e-Filing and open Pending Actions > e-Proceedings; download and read the defective-return notice, verify its year, section, defect and response limit; compare the defect with the filed ITR and source records; choose the response route the notice permits (agree and provide corrected ITR JSON where required, or disagree with a reason); submit in the portal and keep the transaction ID and View Response record; monitor the proceeding and any later processing result.

Authenticate the notice and capture its actual deadline
Do not respond through a link in an unexpected email or pay anyone who promises to remove a notice. From the official Income Tax e-Filing homepage, use ‘Authenticate Notice / Order issued by ITD’ and verify the Document Identification Number (DIN), or use the Department's alternative authentication fields. Then sign in by typing the official portal address yourself and check Pending Actions > e-Proceedings for the same notice. Record the section cited, assessment year or tax year, date received, response due date and whether it is specifically labelled a defective return. The Department's guidance describes a 15-day period or the different duration stated in the notice and allows an extension request in some cases; use the notice's date and portal status, not a generic calendar estimate. A proposed adjustment notice follows a separate response flow.

Read the notice and identify exactly what the return must fix
In e-Proceedings, open ‘View Notice’ for the defective-return item, open ‘Notice/Letter PDF’ and download a private copy. Match the defect description to the filed return, schedules and evidence—for example, an omitted receipt despite claimed TDS credit, a name mismatch with PAN records, or missing business statements. Check whether the notice says to agree, disagree, upload a corrected return file or provide an explanation, and note any permitted file type/size. The Department's portal manual distinguishes defective-return notices from section 143(1)(a) proposed adjustments; if your notice is not a defective-return notice, stop and use the matching official guidance instead of following these steps.

Reconcile the defect with records before choosing a response
Compare the filed ITR with the notice and reliable source records such as Form 26AS/AIS, bank and business books, deduction evidence and the filed schedules. Decide whether the stated defect is correct. If you agree, identify the specific correction and generate the right ITR type/JSON using the Department's current offline utility or portal option named in the notice. If you disagree, prepare a concise, factual reason tied to the notice and the supporting records requested there; do not simply repeat the original return. The Department says a fresh or revised return may be an option only while the relevant filing window remains open; after it closes, the notice response route may be required. Because the applicable section, years and consequences depend on the case, get a Chartered Accountant or tax professional to review an uncertain or material correction.

Submit the permitted correction or explanation in e-Proceedings
Return to the matching defective notice under Pending Actions > e-Proceedings, choose ‘View Notice’ and then ‘Submit Response’. Follow the choices actually shown for that proceeding. In the Department's documented offline branch, select ‘Agree’, choose the response mode and correct ITR type, attach the validated JSON file and submit. If you select ‘Disagree’, enter the factual reason for disagreement and submit as the portal directs; attach only evidence the proceeding asks for. Do not choose the agree route merely to clear the notice, and do not state that an adjustment is accepted when the issue is a defective return. The Department says a submitted e-Proceedings response cannot be edited or withdrawn, so review the year, notice, answer and attachment before the final submit action.

Save the transaction record and monitor the proceeding
After submission, confirm that the portal displays success and a Transaction ID, then open ‘View Response’ and save the response/remarks record with the notice PDF and date. Check the registered email for the Department's confirmation, but use the signed-in portal as the authoritative record. If the due date is near and you cannot complete the response, use the official ‘Seek Adjournment’/extension option if available for that proceeding and retain its acknowledgement; a request is not proof that an extension was granted. If the submit action is closed, contact the Department through the official e-Filing help channel and speak to a tax professional promptly. Recheck e-Proceedings for later queries and separately check the ITR processing outcome; a response receipt confirms submission, not acceptance of the tax position or final processing.
